TERMS & CONDITIONS

General 

The following Terms and Conditions apply to all clients, hereinafter referred to as “Client”, who purchase an online program, services or 1:1 online coaching from Handball Performance Hub International AB, hereinafter referred to as “HPH”. By placing an order, you agree to be bound by these terms.

Online programs purchased through the website

Online programs may consist of videos and documents. 
The duration of an online program is 18 weeks.
The client agrees to provide current, complete, and accurate purchase and account information for all purchases made via our website.
After purchase by the client these programs are made available to the customer via the XPS Network App from Sideline Sports. 
If the client did not receive information on how to access their program within 24 hours after the purchase via email they must contact support@handballperformancehub.com
The client will have access to the program and its contents for 6 months. 
If the client states during their purchase, by selecting the applicable options before check out, that they have an existing XPS account, the HPH will try to connect their account to the client's account and give access to the program to the account associated with the email address used for purchase. 
If the client states they have no existing XPS account the HPH will set up an account with the email used for purchase. The client will have to give themselves a password.
The HPH will supply the client's XPS account with a XPS user license for the duration of the online program.
The client has the right to withdraw from the purchase within 14 days after the purchase without giving any reason.
To exercise the right of withdrawal, the client must inform the HPH of their decision to withdraw from the purchase by a clear statement sent via email. 
If they withdraw from this contract, the HPH shall reimburse all payments received.
Once the client logged into their XPS account after purchase they are not eligible for a refund anymore. 
Clients must not share their login details with third parties, or allow others to access the online programs via their accounts.

1:1 Coaching

1:1 Coaching consists of online or in-person meetings of an expert selected and contracted by the HPH and the client. 
The Fundamental 1:1 Coaching Package has a duration of 12 weeks and includes 6  meetings.
The Advanced 1:1 Coaching Package has a duration of 12 weeks and includes 12 meetings.
The meetings have a duration of 55 minutes. 
The meetings take place via the video platform Google Meet unless the client and HPH agree that the meetings take place in person (has to be documented in writing).
Time and date for the meeting are agreed upon by the client and the expert contracted by the HPH.  The meetings are binding for both parties. If the client misses a 1:1 online appointment without notifying the HPH via support@handballperformancehub.com or the HPH contracted expert directly, at least 24 hours in advance, the meeting will be treated as if it happened. 
If the client cancels in time, the client and expert shall attempt to find an alternative date in the same week or the following week.
If the client is unable to use the 1:1 coaching sessions for health reasons or circumstances (pregnancy, illness or similar health restrictions), the contract is suspended for the duration of the condition. An illness is recognized if the client presents a written document by a medical doctor. The term of the contract is extended in accordance with the client's downtime.
Clients that have either purchased a fundamental or advanced online coaching package may buy single additional meetings that prolong the term of the initial contract.  
Purchased online coaching meetings are only transferable with the consent of the HPH.

Costs & Payment

Online Programs are subscription based with 4 monthly charges.
Online programs and 1:1 coaching must be paid via the payment link provided in the invoice by the HPH.
The HPH may offer the option to pay the amount for the 1:1 coaching package in installments. 
If a charge fails, any costs are to be paid by the client and will be invoiced plus a flat-rate charge of €10.
All other costs incurred in connection with the fulfillment of the booked service (rent, entrance fees, equipment rental fees, accommodation costs, catering costs or similar expenses for the fulfillment of the contract) shall be borne by the client. The costs shall be documented on the basis of receipts.


Gift Cards
Gift Cards will be delivered electronically to the email address provided at the time of purchase.
Gift Cards can be redeemed only on our online store for the purchase of eligible products. To redeem a Gift Card, enter it at checkout.
Gift Cards do not have an expiry date unless otherwise specified.
Gift Cards are non-transferable and cannot be redeemed for cash or used to purchase other Gift Cards.
Gift Cards cannot be returned or refunded except as required by law.
We are not responsible for lost, stolen, or unauthorized use of Gift Cards. 
We reserve the right to cancel any Gift Card or suspend the redemption of any Gift Card if we suspect that the Gift Card was obtained, used, or applied to a purchase fraudulently, unlawfully, or otherwise in violation of these Terms.

Minors / persons not of legal age
There is no minimum age for the services of Handball Performance Hub International AB. Minors must be represented by a parent or legal guardian when concluding a contract. The parent or legal guardian must be present when booking a product on the website. Handball Performance Hub International AB accepts no liability or refunds for bookings made by minors in the absence of a parent or legal guardian.


Intellectual property
All online programs, their video content, structure and materials are the intellectual property of the HPH. Reproduction or copying without the written consent of the HPH is prohibited.
All information and materials acquired and developed during the 1:1 coaching are the intellectual property of the HPH. 


Liability
Participation in the online programs or 1:1 online coaching, as well as training according to the training plans of the HPH or its vicarious agents is at the clients own risk and peril.
The client waives all claims - of any kind whatsoever - arising from damage, injury or consequential damage:

  • in connection with participation in a training session,

  • the online program,

  • the 1:1 coaching, unless the aforementioned persons act with intent or gross negligence.

Liability on the part of the HPH or its vicarious agents for damage to property is excluded, unless the aforementioned persons act with intent or gross negligence.
The client recognizes the house rules, which are displayed in the respective gyms, platforms or event locations, as binding. Damage to property in the respective gyms or event locations will be repaired at the expense of the person who caused it.
The HPH is not liable for the loss of clothing, valuables or other items or money brought to the unit, lecture or event.
The HPH shall not be liable for any failure to achieve the purpose pursued by the client.
The client is obliged to obtain clarity about his state of health through a medical examination and assures that they are in good health at the start of the online programs or 1:1 coaching. If they do not consult a doctor, they do so at their own risk and against the recommendation of the HPH.
The client is also obliged to inform the HPH fully and truthfully about his previous and current state of health.
Any illness or sudden changes in well-being such as nausea, dizziness, pain, palpitations or similar must be reported immediately to the HPH or its vicarious agents and may result in the  meeting being canceled.
In the event of an accident or damage, the HPH or its vicarious agents shall assume no liability for health risks, including those of which the client itself is not currently aware.
The client must ensure that he is insured against accidents and injuries that may occur. 


Data protection & confidentiality
The HPH shall store and use the client's personal data collected exclusively for the fulfillment of the contract.
The contractor shall be obliged to maintain confidentiality regarding all information of the client of which it becomes aware in the course of fulfilling the order. This obligation shall apply beyond the term of this contract. Exceptions to this are cases in which the information concerned is already publicly accessible, or in which the information concerned must be disclosed due to a statutory provision or a court or official order.
The exchange of information with cooperation partners such as physiotherapists or doctors requires the express approval of the client. The client can revoke this at any time.


Governing Law and Dispute Resolution
These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of Sweden. Any disputes arising out of or relating to these Terms shall be resolved by the courts of Sweden.


Final provisions
Verbal agreements are not valid; any changes must be made in writing. Should parts of the general terms and conditions be invalid or void, the remaining terms and conditions shall remain unaffected. In place of the invalid or void conditions, the corresponding statutory law shall come into force.
